Article 1: Scope                            


This privacy statement is applicable to the collection and processing of personal data by NHV NV, a Belgian limited liability company with registered office at Kalkaertstraat 101, 8400 Oostende, Belgium, registered in the Crossroad Bank for Enterprises under number 0460.718.920  and by all affiliated companies of NHV (hereinafter: “NHV”).

This privacy statement covers the processing of your personal data by NHV when you visit this website or when you contact NHV with requests for information or to arrange for a visit.  

This privacy policy is in accordance with the General Data Protection Regulation (EU) 2016/679.

Article 2: The personal data we collect  


Personal data processed by NHV may include:

personal identification information (such as first name and surname, address, telephone numbers, e-mail address), financial information; other information that would have been provided by you either in writing, or by filling out forms or during conversations or contacts that you have with NHV representatives.

NHV will not process any sensitive or special category of personal data. NHV will not process any personal data on children.


Article 3: Where we collect your personal data


NHV processes personal data that have been provided by you directly to NHV or that have been obtained by NHV while providing you with information or services that have been requested by you or by your organization.

You may also submit personal data through the “Contact” section of the site.


Article 4: The use of personal data

This personal data will be used by NHV, or by service providers acting on behalf of NHV, to provide you with information or services that you have shown interest in or that you have requested from NHV. Personal data can also be processed in order to fulfill legal obligations, to process job applications or to organize your visit of the NHV premises. 

NHV has entered into processing agreements with any third party service providers that process personal data on its behalf. These processing agreements contain the same level of guarantees with regard to the use and security of personal data as the level of guarantees NHV is subject to itself.  NHV remains responsible for the processing of personal data by service providers acting on its behalf.

Your personal data will not be transferred for use by third parties, except by service providers who are acting on behalf of NHV.              

NHV will not export any personal data outside the European Union and will not allow any provider acting on its behalf to export any personal data outside the European Union if such export is not covered by an EU adequacy decision. An EU adequacy decision guarantees a level of protection that is essentially equivalent to the protection offered in the European General Data Protection Regulation.


Article 5: The legal grounds for processing personal data      


NHV processes personal data on either of the following grounds: the processing is required in order to provide you with the information that you have requested or to provide our services to you or to the organization on whose behalf you are acting ; or our legitimate interests, in the effective and normal operation of our business so long as such interests are not outweighed by your interests or rights.


Article 6: The storage of personal data  


NHV will not store personal data any longer than required for the purpose for which such information (i) is processed, (ii) is necessary to enable NHV to meet its legal obligations, (iii) is necessary  to respond to any inquiries or claims, (iv) is necessary in order to secure the systems of NHV or (v) is necessary to keep up appropriate business documentation. Such as: personal data provided by you in relation to a request for information or to subscribe to a newsletter will only be stored for one year after such request or for one year following the termination of the subscription. Personal data provided by you for or obtained in the performance of a service contract will be stored for maximum ten years following the year of the termination of the service.


Article 7: The protection of personal data         


NHV takes all appropriate technical and organizational measures to ensure adequate safety and protection of Personal Data against loss or any form of careless, incompetent or abusive use or processing. 


Article 8: Your rights with regard to your personal data        


You can request details of the personal data we are holding on you. NHV provides you with the opportunity to access your personal data to keep this information accurate and up-to-date.

At any time you have the right to (i) rectify, (ii) erase, (iii) restrict the processing of your personal the data, (iv) obtain confirmation whether or not your personal data is processed by NHV, (v) access your personal data, (vi) exercise your right to data portability and (vii) withdraw your consent to processing.

If you want to exercise one of these right, you send an e-mail, provided with a copy of your identity card to NHV – Legal Department, Kalkaertstraat 101, 8400 Oostende, Belgium or at privacy@nhv.be. The request can be made by filling in a standard form.

We are not always obliged to respond to your request (for example because of legal obligations), but we will always respond within the legally stipulated period and explain our possible refusal.
